Agreement to Terms
These Terms and Conditions ("Terms") govern your access to and use of the website located at quantumbusinessschool.com and your enrollment in any program offered by The Quantum Business School ("QBS," "we," "us," or "our").
By accessing our website, submitting an application, or enrolling in any QBS program, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our website or enroll in our programs.
Important: These Terms include a limitation of liability and disclaimers of warranties that affect your legal rights. Please read them carefully, particularly Sections 09 and 10.
Section 02
Eligibility
To use our website or enroll in any QBS program, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from receiving our services under applicable law
By using our website or enrolling in a program, you represent and warrant that you meet these eligibility requirements. If you do not meet these requirements, you are not permitted to use our website or enroll in our programs.
Section 03
Enrollment and Access
Enrollment in a QBS program is subject to acceptance of your application, payment of applicable tuition, and agreement to these Terms. QBS reserves the right to decline any application at its sole discretion.
Access to Course Content
Upon enrollment and receipt of payment, you will receive access to your enrolled department's course content through the QBS student dashboard and the relevant instructor's platform. Course content is delivered through third-party platforms operated by QBS faculty members. Your access to those platforms is subject to the terms of service of each platform.
Lifetime Access
Enrolled students receive lifetime access to the course content available in their department at the time of enrollment. QBS does not guarantee that specific course content will remain available indefinitely, as instructors may update, modify, or retire content at their discretion. We will make reasonable efforts to provide advance notice of material content changes.
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials. You may not share your account access with others. Each enrollment is for individual use only. You agree to notify QBS immediately if you believe your account has been compromised.
Section 04
Payment
Tuition is due at the time of enrollment unless a payment plan has been explicitly agreed upon in writing by QBS. All tuition is stated and charged in US dollars.
Payments are processed through secure third-party payment processors. By submitting payment, you authorize QBS to charge the applicable tuition amount to your chosen payment method.
If a payment plan has been arranged, failure to make scheduled payments may result in suspension of your course access until the outstanding balance is resolved.
Founding member pricing, where applicable, is non-transferable and valid only for the individual who enrolled at that rate.
Section 05
Refund Policy
Students who have not accessed more than 20 percent of their enrolled department's course content may request a full refund within 30 days of their enrollment date.
After 30 days from the enrollment date, or after more than 20 percent of course content has been accessed, no refunds will be issued regardless of the reason for the request.
To request a refund, you must submit a written request to QBS within the 30-day window. Refund requests submitted after the 30-day window will not be considered. Approved refunds will be processed within 10 business days.
For complete refund terms, see the Accreditation and Disclosures page. The refund terms in these Terms and Conditions and the Accreditation and Disclosures page are the same. In the event of any conflict, the terms on the Accreditation and Disclosures page will control.
Section 06
Course Content and Educational Purpose
All content provided through The Quantum Business School, including course materials, live sessions, written materials, recordings, and any other program components, is provided for educational and informational purposes only.
QBS content does not constitute legal, financial, investment, tax, medical, psychological, or therapeutic advice. See the Accreditation and Disclosures page for full disclaimers applicable to specific departments.
QBS does not guarantee any specific educational, business, or financial outcome as a result of completing any program. Results vary based on individual effort, circumstances, and factors outside QBS's control.
Third-Party Platforms
Course content is delivered through platforms operated by QBS faculty members. QBS is not responsible for the content, availability, terms of service, or practices of those third-party platforms. Your use of those platforms is governed by their respective terms and privacy policies.
Section 07
Intellectual Property
All content on the QBS website, including text, graphics, logos, images, and the overall design and arrangement of the site, is the property of The Quantum Business School or its content suppliers and is protected by applicable intellectual property laws.
Course content is the intellectual property of the respective instructors and is licensed to enrolled students for personal, non-commercial educational use only. You may not:
- Copy, reproduce, distribute, or publicly display course content without written permission
- Record or capture course sessions or materials for redistribution
- Use course content to create competing educational programs or materials
- Share your account credentials or course access with others
- Sell, sublicense, or transfer your enrollment or course access to any third party
Any unauthorized use of QBS intellectual property may result in termination of your enrollment without refund and may expose you to legal liability.
Section 08
Student Conduct
As a QBS student, you agree to conduct yourself in a manner consistent with the values and standards of The Quantum Business School. You agree not to:
- Harass, intimidate, or disrespect faculty members, staff, or fellow students
- Post or share defamatory, false, or misleading content about QBS, its faculty, or its students
- Engage in any conduct that disrupts the educational experience of other students
- Misrepresent your identity, qualifications, or affiliation with QBS
- Use QBS platforms or content for any unlawful purpose
- Attempt to gain unauthorized access to QBS systems or the accounts of other students
QBS reserves the right to terminate the enrollment of any student who violates these conduct standards, without refund, at its sole discretion.
Section 09
Disclaimers of Warranties
THE QBS WEBSITE AND ALL PROGRAMS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. QBS disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
QBS does not warrant that:
- The website or course platforms will be uninterrupted, error-free, or free of viruses or other harmful components
- The content provided in any program will be accurate, complete, or current at all times
- Any particular educational, business, or financial outcome will result from enrollment in any program
- Third-party platforms used to deliver course content will be available at all times
Your use of the QBS website and enrollment in QBS programs is at your sole risk.
Section 10
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QBS AND ITS FOUNDERS, OFFICERS, EMPLOYEES, FACULTY, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising out of or related to your use of the website, enrollment in any program, or any content provided through QBS programs.
In no event shall QBS's total liability to you for all claims arising out of or related to these Terms or your enrollment exceed the total amount of tuition paid by you to QBS in the twelve months preceding the claim.
Some jurisdictions do not allow the limitation of liability for certain types of damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.
Section 11
Indemnification
You agree to indemnify, defend, and hold harmless The Quantum Business School and its founders, officers, employees, faculty, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:
- Your access to or use of the QBS website or programs
- Your violation of these Terms
- Your violation of any third party's rights, including intellectual property rights
- Any content you submit or share through QBS platforms
Section 12
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions.
Any dispute arising out of or related to these Terms or your enrollment in a QBS program shall first be addressed through good-faith negotiation between the parties. If negotiation does not resolve the dispute within 30 days, the parties agree to submit the dispute to binding arbitration in St. George, Utah, under the rules of the American Arbitration Association.
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent or address intellectual property infringement or unauthorized use of confidential information.
You agree that any claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
Section 13
Changes to These Terms
QBS reserves the right to modify these Terms at any time. We will post the updated Terms on this page with a revised effective date. For material changes, we will notify enrolled students by email at least 14 days before the changes take effect.
Your continued use of our website or participation in any QBS program after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must discontinue use of our website and, if applicable, request termination of your enrollment in accordance with our refund policy.
